Sunset Review 2021

The Antidumping Duty (“AD”) Order on Petroleum Wax Candles from China held its 5th Sunset Review this year, which determined whether the Order should continue in effect or be revoked (i.e., sunset).  The entire U.S. industry benefits from the existing AD Order on Candles from China.   

Our industry has invested a tremendous effort over the years to gain and maintain this AD Order which continues to contribute to the existence and health of our industry.

In early 2021, the National Candle Association (NCA) filed our entry of appearance for the 5th Sunset Review with both Commerce and the International Trade Commission (ITC).  NCA reported in late 2021 that both the Commerce Department and the International Trade Commission recommended an expedited review for the 5th Sunset Review.  An expedited review is extremely important because it saved the NCA a lot of time and money defending the order. 

  1. Commerce and ITC are required to conduct five year reviews of an antidumping duty order to determine if the order should be revoked.
     
  2. Commerce is responsible for determining whether revocation of an order would likely lead to a continuation or recurrence of dumping.
     
  3. ITC is responsible for determining if revocation of an order would likely result in material injury or threat of material injury to the domestic industry.

In July 2021, the Commerce Department indicated that revocation of the tariffs would likely lead to continuation or recurrence of dumping.  Commerce determined to keep the anti-dumping duty order in place, and in September 2021, ITC ruled in favor to continue the antidumping duty order for another five years.
 
Once again, the NCA was victorious in defending the order! That is a big win for the candle industry.
